Definition of a contract - A contract is an agreement between two parties. It consists of an offer, acceptance, and consideration. Consideration is what is given in exchange for the other party's promise to perform. The offer and acceptance must be freely given.

Seminal Contracts case concerning --- consideration --- : Pillans v Van Mierop (1765) - This case took place in England. It is about two bankers, one named Pillans and a company. Van Mierop. White gave his bill to Pillans the banker, and Van Mierop agreed to back the bill. White went insolvent. Van Mierop would no longer guaranty the bill. Pillans the banker sued Van Mierop. The court held that even though Van Mierop argued that this was past consideration, and there was no current consideration, Van Mierop was required to pay as he had agreed to do so. The court said that it would not be helpuful amongst business people if they did not pay when they agreed to do so.

Seminal Contracts case concerning --- anticipatory repudiation --- : Hochster v De La Tour (1853) -This case took place in England. In this case, De La Tour had contracted with Hochster for Hochster to be his courier for three months. A month before Hochster was scheduled to begin, De La Tour said he did not need him. Hochster sued the next week. The court held that De La Tour had engaged in anticipatory repudiation of the contract and had to liable for damages to Hochster.
